Terms of Service

By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms, and “you” means both you and the business.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is for sellers running their own stores; it is not directed at consumers or children.

You create an account with an email address and password. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us at accounts@podmach.com right away if you believe your account has been accessed without permission.

Keep the information on your account accurate and current, including the email address we use to reach you about billing and service notices.

PODMach connects to the sales channels and print-on-demand provider you already use — currently Etsy, Shopify, WooCommerce and Printify — so you can manage listings, orders, inventory and product mockups from one dashboard. We may add, change or remove supported platforms over time.

You authorize the connections. When you connect a store or provider, you authorize PODMach to access and act on that account through its API on your behalf (for example, to read orders, create or update listings, and sync inventory). You can disconnect a platform at any time from the application or from that platform’s own settings.

Their terms still apply. Etsy, Shopify, WooCommerce, Printify and any other connected platform have their own terms, policies and fees. You are responsible for complying with them. PODMach is an independent product and is not affiliated with, endorsed by or sponsored by any of those companies; their names and marks belong to their respective owners.

Your listings and orders are yours. PODMach is a tool. You decide what to list, at what price, and how to fulfil and ship it. You remain the seller of record on every channel, responsible for your product descriptions, pricing, taxes, fulfilment, customer service, refunds and compliance with the laws that apply to your sales. We do not guarantee that a connected platform will accept, publish or keep any listing, or that any order will be fulfilled.

PODMach is sold as a subscription. Current plans (Listings, Launch and Pro) and prices are shown on the pricing page, billed monthly or annually in US dollars. Payments are processed by Stripe; we do not store your full card details.

Free trial. Every paid plan starts with a 7-day free trial. We verify your card when you sign up but do not charge it during the trial. If you cancel before the trial ends you will not be charged. If you do not cancel, your first payment is taken when the trial ends and your subscription begins. One trial per customer.

Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for your plan, until you cancel. You authorize us and Stripe to charge your payment method for each renewal.

Price changes. We may change plan prices. We will give you at least 30 days’ notice by email before a price change takes effect on your subscription, and it will apply from your next renewal after that notice. If you do not agree, cancel before the change takes effect.

Cancellation. You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period; you keep access until then and are not charged again.

No refunds. Payments are non-refundable. When you cancel, you simply are not charged again: your plan runs to the end of the period you have already paid for and then stops. We do not refund or credit the current period, unused time, downgrades, or features you did not use, except where the law requires a refund. Plan changes and limits. Each plan has limits (such as connected stores, listings or MACH AI credits) described on the pricing page. You can upgrade or downgrade from your account through the billing portal; any proration for a plan change is reflected on your next invoice. Taxes may be added where required.

Failed payments. If a renewal payment fails we may retry it and notify you. If it is not resolved, we may suspend or downgrade your account until it is.

MACH AI drafts listing copy — titles, descriptions and tags — using a monthly allowance of credits that comes with your plan. Credits reset each billing period, do not roll over, and have no cash value.

Drafts are suggestions, not advice. Review every draft before you publish it. We do not guarantee that AI-generated copy is accurate, original, free of third-party rights, compliant with a platform’s policies, or that it will rank or convert. You are responsible for what you publish under your name and shops.

You own your content. Your designs, product images, listing copy, order data, digital files and anything else you upload to or create in the Service (“Your Content”) stay yours. These Terms do not transfer ownership to us.

License to operate the Service. You grant PODMach a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content solely to provide, secure and improve the Service for you — for example, to push a listing to your Etsy shop or generate a mockup. We will not sell Your Content or use it to promote PODMach without your permission.

Your promises about Your Content. You confirm that you own or have the rights to use everything you upload, that it does not infringe anyone else’s intellectual property or other rights, and that it complies with the law and the policies of every platform you publish it to.

Digital Download Manager. The Digital Download Manager (DDM) delivers your digital products to your buyers with the expiry dates and download limits you choose. Those products are yours and the sale is between you and your buyer. You set the terms of that sale and you handle your buyers’ questions, support and refunds. PODMach provides the delivery mechanism only and is not a party to your sales.

Backups. We take reasonable steps to protect Your Content, but you are responsible for keeping your own copies of your designs and files.

PODMach University — the guides, learning paths, downloadable checklists and PDFs — is free to read and use for your own business. We grant you a personal, non-transferable license to use that material for that purpose.

You may not republish, resell, redistribute, bundle or present University content (or substantial parts of it) as your own, in any format, without our written permission. Quoting short excerpts with a link back to the source is fine.

University content is general information based on our experience, not legal, tax, financial or professional advice. Platform fees, policies and best practices change; check the current rules of each platform before you rely on anything.

You agree not to use the Service to:

• break any law, or any platform’s terms or policies, including by selling counterfeit, infringing, prohibited or unsafe goods;
• upload content you do not have the rights to, or that is defamatory, hateful, harassing or deceptive;
• share your account with others or access someone else’s account or stores without permission;
• scrape, crawl, reverse-engineer, copy or interfere with the Service, or probe or test its security without our written consent;
• send spam, malware or unsolicited messages through any connection the Service provides;
• resell or offer the Service to third parties as a service bureau, or build a competing product using it;
• use automated tools in a way that places an unreasonable load on the Service or a connected platform.

We may investigate suspected violations and suspend or terminate accounts that break these rules.

The Service — including its software, design, text, graphics, the PODMach name and logo, MACH AI, and PODMach University — is owned by PODMach or its licensors and protected by copyright, trademark and other laws. Apart from the rights expressly granted in these Terms, we reserve all rights. You may not use our names or marks without permission.

If you send us feedback or suggestions, we may use them without obligation to you.

If you believe content available through the Service infringes your copyright, email support@podmach.com with the details and we will respond promptly.

How we collect, use and protect personal information is described in our Privacy Policy, which is part of these Terms. By using the Service you consent to that processing. Where you provide us with personal data about your buyers (for example, through orders or the Digital Download Manager), you are responsible for having the right to share it with us and for your own obligations to those buyers.

We work to keep the Service available and reliable, but it depends on third-party platforms, APIs and hosting we do not control, and it will sometimes be unavailable for maintenance or for reasons outside our control. We do not promise uninterrupted or error-free operation.

We may change, add or discontinue features, plans or supported platforms. If we discontinue a feature that materially affects your plan, we will try to give you reasonable notice.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will meet your requirements, that data will sync without error, that listings will be accepted by any platform, or that using the Service will produce any level of sales, ranking or profit. Calculators and examples on our site are estimates for planning only.

To the fullest extent permitted by law, PODMach and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, sales, data, goodwill or business opportunity, arising out of or related to the Service or these Terms, however caused and under any theory of liability, even if we were advised of the possibility.

Our total liability for all claims arising out of or related to the Service or these Terms is limited to the amount you paid PODMach for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You will defend, indemnify and hold harmless PODMach and its owners, employees and contractors from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of Your Content, your products and sales, your use of the Service, your breach of these Terms, or your violation of any law or any third party’s rights.

You may close your account at any time from your account settings or by emailing accounts@podmach.com. Closing your account cancels your subscription at the end of the current billing period.

We may suspend or terminate your access if you breach these Terms, if required by law or a connected platform, if your payment fails and is not resolved, or if we discontinue the Service. Where practical we will notify you first.

After termination we will disconnect your platforms and, after a reasonable period, delete Your Content from our systems (except where we must keep records by law or for legitimate business reasons such as billing). Export anything you need before you close your account. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification and governing law — survive termination.

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Oklahoma, and you consent to their jurisdiction. Before filing a claim, each of us agrees to try to resolve the dispute informally by contacting the other party and allowing 30 days for a response.

You agree to bring claims only on an individual basis, not as a plaintiff or class member in any class or representative action, to the extent permitted by law.

We may update these Terms from time to time. We will post the revised Terms at this address with a new effective date and, for material changes, notify you by email or in the application at least 14 days before they take effect. Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not agree, cancel your subscription before that date.
